Venture capitalist Mark Suster has a rule he lives by that helps him be more productive and successful. The rule: “Do Less. More.” It means doing fewer things overall, and getting the right things done. “Success often comes from doing a few things extraordinarily well and noticeably better than the competition,” he says.

Richard Koch, author of The 80/20 Principle, says, “Everyone can achieve something significant. The key is not effort, but finding the right thing to achieve. You are hugely more productive at some things than at others, but dilute the effectiveness of this by doing too many things where your comparative skill is nowhere near as good.”

Koch also says, “Few people take objectives really seriously. They put average effort into too many things, rather than superior thought and effort into a few important things. People who achieve the most are selective as well as determined.”

So, what do you do better than most? What should you focus on? I asked this question in an earlier post:

Look at your practice and tell me what you see.

  • Practice areas: Are you a Jack or Jill of all trades or a master of one? Are you good at many things or outstanding at one or two?
  • Clients: Do you target anyone who needs what you do or a very specifically defined “ideal client” who can hire you more often, pay higher fees, and refer others like themselves who can do the same?
  • Services: Do you offer low fee/low margin services because they contribute something to overhead or do you keep your overhead low and maximize profits?
  • Fees: Do you trade your time for dollars or do you get paid commensurate with the value you deliver?
  • Marketing: Do you do too many things that produce no results, or modest results, or one or two things that bring in the bulk of your new business?
  • Time: Do you do too much yourself, or do you delegate as much as possible and do “only that which only you can do”?
  • Work: Do you do everything from scratch or do you save time, reduce errors, and increase speed by using forms, checklists, and templates?

Leverage is the key to the 80/20 principle. It is the key to getting more done with less effort and to earning more without working more.

Take some time to examine your practice, and yourself. Make a short list of the things you do better than most and focus on them. Eliminate or delegate the rest.

Another “fee raising” success story

I spoke to another attorney yesterday who told me that, at my urging, he increased his fees approximately 40% and has received no resistance. His fees were low to begin with, he said, but this has emboldened him to increase his fees even further.

He said the top of the market is still 70% higher than his new fee, and we talked about what he would need to do to justify another increase.

You don’t have to be the top of the market, I told him, but you should at least be in the top one-third to 20%.

But don’t be so quick to dismisss “top of the market” fees. Why couldn’t you be the most expensive guy in town?

You could. The question is how.

Much of marketing is about perception. To some extent, you’re worth more because you say you are. Who’s to say any different?

Your lower-priced competitors, you say? See, that’s where you’re missing the boat. There is no competition at the top of the market. It’s at the lower 80% of the market where everyone does pretty much the same thing and competes on price and good looks.

If you’re mucking about in steerage, you’ll never maximize your potential.

But there is a limit to how much more you can charge simply because you want to charge more. You’ve got to find something you do better or different than other lawyers, and make that a point of differentiation.

One way to do that is to specialize not only in the services you offer but the clients for whom you perform those services. Choose a niche market to target, focus on it, and groom yourself to become the “go to” lawyer in that niche.

There are big advantages to this strategy. Besides being able to charge higher fees, marketing is easier and more effective. Instead of networking with or advertising to “anyone” who might need your services or be able to refer clients, for example, you can concentrate your efforts on marketing exclusively to prospective clients and referral sources in your niche market.

That’s what this attorney said he will do.

He’ll save time, spend less on advertising (if not eliminate it completely), and develop a name for himself in his niche.

Word of mouth travels fast in niche markets. By next year at this time, I wouldn’t be surprised to learn that he has indeed become the “go to” lawyer in his market.

The thrill is gone? Here’s how to get it back

The thrill is gone. You’ve lost the spark you had when you started practicing. You’re spinning your wheels and getting nowhere fast.

You’re doing okay, but you want to move on up, to an east side apartment in the sky.

Or maybe things aren’t so good. You’re struggling and falling behind.

What can you do? How do you get things moving?

You need to start over. Go back to the beginning and be “new” again. Forget what you have and what you know and begin from square one.

Before you can construct, you have to destruct.

I know, starting over might hold some bad memories for you. It does for me. I was scared to death. Everything was riding on my making a go of things and I didn’t have a clue about what to do.

But I was excited. The world was mine for the taking. Anything was possible.

And I was hungry. Determined. Open to anything. I had nothing, so I had nothing to lose.

You too? Good. Go back to those days in your mind. Be hungry again. Be open again. Be excited again.

Pretend you have nothing. No clients, no lists, no website, no ads. Chuck it all and start from scratch. You’ll add them back one at a time. Or maybe you won’t.

Yes, but what do you do? That’s not really important. If your head is on right and you are truly reborn, you’ll figure it out.

You’ll try lots of things, with no expectations. Some will work, most won’t. You want this thing to work and you’ll do whatever it takes to make that happen.

Get out a legal pad and a pen. Time to start building. Start by taking inventory.

Who do you know? Write down the names of people who might be able to help you. Clients, prospects, referral sources, other lawyers who can give you advice, friends and family who can support your dreams.

What do you know? What are you good at? What are your skills (legal, marketing, management, leadership, speaking, writing, etc.)

What do you want? Write down one or two goals for the month. Forget next month for now; you’ve got a rent payment coming due.

Are you excited yet? Scared? Itching to do something? Good. Pick up the phone and call someone on your list.

Call a friend and tell him you’re re-launching your practice today and just wanted to share the good news.

Call a lawyer and tell her you’d like to meet for coffee and talk about how you can work together.

Call a former client and see how they’re doing. They might need you for something, or know someone they can refer.

Call a current client and tell them how much you appreciate them.

Spend the rest of the day talking to people. Tonight, write down some marketing ideas. Tomorrow, get up early and do it again.

How’s biz? Yes, I know, it’s great. But really, how are you doing this month compared to last month or last year?

You need to know.

You’ve got to track your progress. Otherwise, you won’t know if what you’re doing is working.

How many new clients did you sign up this week or this month? Write that down.

How much revenue came into your coffers? You should probably make a note.

How many leads/inquires/prospects do you have in your pipeline? You’ll want that number going up.

Look at your calendar. How many appointments do you have this week? How many of those are with prospective clients?

How many subscribers signed up for your newsletter this month?

You’re running a business. You’ve got to know your numbers. You don’t need to obsess over them, but you should at least know what they are.

Your numbers tell you if what you’re growing. Because if you’re not growing, you’re dying.

But these aren’t the only ones you need to track.

Revenue, new clients, and the like, are all “history”. They are the results of things you did in the past. They tell you what happened, not what will happen.

You need to track your activities as well as as your results.

What did you do this week that might bring you some business?

Whatever else you do that for marketing, I suggest you start tracking these two activities:

1) Calls

How many outgoing calls did you make–to prospects, referral sources, prospective networking partners, former clients, etc.

2) Words

How many words did you write for marketing purposes, for your blog, website, articles/guest posts, books, presentations, letters/emails, social media content, etc.

Are these numbers growing? Holding steady? Declining? You need to know.

Results are the destination. Activities are how you get there.

Our cat is getting his teeth cleaned this morning. Fun times.

As I grabbed him up and settled him in his cage, I thought about a consultation I did the other day with the marketing support person at a mid-size law firm. We talked (a lot) about her challenges in getting the lawyers to do anything marketing related.

She’s a lawyer wrangler. So am I.

It’s frustrating to talk to lawyers, give them million dollar advice, and know they probably won’t follow any of it. Lawyers don’t like change. They don’t like getting out of their comfort zone.

We talked about several ways she might get buy-in about the marketing agenda. I suggested she start by trying to get at least one lawyer on board and doing something, e.g., write an article for the website. I told her to make a big fuss about the article in the firm’s internal newsletter (which I suggested she start). As the other lawyers see one of their own being feted, their competitive nature might kick in and a few others might get with the plan.

You might want to do that yourself. Talk to some attorneys you know who are doing a decent job with marketing and ask them about what they’re doing. Find out how much business they’re bringing in. Get jealous, and then do something.

Start small. Outline an article, perhaps. Call a client you like and say hello.

The hardest part of marketing is getting started. The best way to do that is to schedule time for it. Schedule a 15 minute “marketing” appointment with yourself each week day. Put it on your calendar and tell your staff not to book anything during that time.

Go ahead, block out the rest of the month.

Will you do this? Today? What do you mean, you’re not sure?

Come on, you can do this. Stop looking like Grumpy Cat and block out a few minutes a day for marketing. If you do, I’ll let you sleep for the next 16 hours.

Relax, don’t do it, when you want to go to it

Author Raymond Chandler said something about his writing process that resonates with me. He said, “The faster I write the better my output. If I’m going slow, I’m in trouble. It means I’m pushing the words instead of being pulled by them.”

Writing faster allows him to bypass the resistance he feels when he tries to force his way forward through the story. When he lets go, he gets better results.

I’ve found this to be true in my writing. When I write quickly, I write better and more naturally.

This morning, I thought about this idea in the context of marketing and building a law practice. Many lawyers force themselves to do the things they are told they need to do to achieve success. Pushing through their resistance, however, often leads to poor results.

Some things we resist simply need to be done. For these things, the best advice is to be do them quickly. Like pulling off a bandage, get it over with so you can move on to other things.

When I have to make a call I’m not looking forward to making, for example, I don’t think about it or plan it out, I just pick up the phone and punch in the number. Before I know it, the conversation is over.

Much of what we do is discretionary, however. We don’t have to engage in formal networking, for example, but many lawyers who hate it force themselves to do it. Not surprisingly, they get poor results.

Think about the many possible ways to market your services. As you run down the list, ask yourself how you feel about each method. When you find something that creates a “tug” in your gut, something that feels right to you and fraught with possibilities, that’s what you should do.

There may be only one “reaching out” method that feels good to you when you think about it, but that’s enough. You’ll do it with gusto and you will do it well. You’ll get good at it and your results will multiply.

Don’t push through the sludge and force yourself to do things you hate. Let go of things you resist and allow yourself to glide towards success.

What if nothing appeals to you? What if you can’t stand anything that bears the marketing label?

Some of it you can skip. Some of it you can delegate. But if it has to be done and you’re the one who has to do it, don’t think about it, just rip that sucker off.

Imagine there’s no Internet. It’s easy if you try.

If the Internet didn’t exist, how would you go about marketing your services? Think about this for minute or two. Write down some ideas.

Go ahead. I’ll wait.

If you were around before the Internet, you can probably remember what you did. Write that down.

Finished? Good. What did you say?

Let me guess.

You would build relationships with prospective clients and with people who can refer them. You would build your reputation in your community or target market by speaking and writing and networking with centers of influence. You would create content (brochures, articles, white papers, reports, books, audios) that demonstrate your knowledge and experience. And you would work you tush off for your clients and generate repeat business and referrals.

There might be a few other things you would do if the Internet didn’t exist. I did a lot of advertising in days past. Maybe you did, too.

Now, look at your list. With a few possible exceptions, you might notice that the things you would do if there was no Internet (and what you did before the Internet) are pretty much the same things you do today.

Marketing doesn’t change. Fundamentals don’t change.

Jim Rohn said, “There are no new fundamentals. You’ve got to be a little suspicious of someone who says, “I’ve got a new fundamental.” That’s like someone inviting you to tour a factory where they are manufacturing antiques.”

Technology makes things easier and less expensive and gives you more options. But you’re still doing the same things.

Mr. Spock was only half right

As a kid, I loved Star Trek. I watched the original series and thought that Mr. Spock’s unemotional, logical approach to problem solving was the way to go.

Examine the evidence. Calculate the probabilities. Make your decision.

I even took a class in logic in college. It was one of my favorites. My professor noticed my enthusiasm for the subject and wrote me a letter of recommendation to law school.

Anyway, I started my legal career with a penchant for logic. I calmly reasoned my way through problems to find the best solutions. I did my best to keep my emotions in check.

And it’s a good thing I did. Those first few years were awful. I didn’t know how to bring in clients and, oh yeah, I barely knew how to do the legal work. Every month was a struggle to survive and if I had let my emotions out of their box, I would surely have fallen apart. Logic got me through some tough times.

Later, when I had turned things around and had a thriving practice, logic only took me so far.

At one point, I had an important decision to make. I can’t recall the subject but I remember having a terrible time deciding what to do. I had a paralegal who saw my consternation and offered a suggestion. She told me that I was more intuitive than I realized and that I should trust my intuition to provide me with the right answer.

I listened to her. And then I listened to the voice inside me that told me what to do.

Whatever the issue was, my intuition provided the solution and the problem is long forgotten.

We should remember that Spock was half-human. Somewhere inside him was a reservoir of intuition and human emotion. We saw flashes of it when he made illogical decisions to save the life of Captain Kirk.

We all have great intuitive powers and we shouldn’t ignore them. There is a voice inside us that wants to guide us but most of us (men) don’t listen.

Feelings, who me? I’m a lawyer. I don’t let my feelings tell me what to do.

Maybe we should. Maybe we should listen to how we feel about things before we make decisions.

I do that now. When I think about choosing A or B, for example, I ask myself how I feel about those options. More often than not, I choose the option that feels better.

I also do that when charting my future. I look at the pantheon of options available to me–all of the projects I could work on, all of the tasks on my master list–and do the ones that I feel pulled toward.

I have one such project I’m working on right now. It’s something I feel good about and I can’t wait to get back to work on it. Isn’t that how our work should always be? Mostly doing things we enjoy?

Look at everything on your plate right now, and everything on your list of ideas. Which one calls to you? Which one feels good when you think about it?

That’s probably what you should do next.

Mr. Spock might not approve, but he’s at the Science station and you’re in the Captain’s chair.

The perfect system for marketing legal services

Thank you for your suggestions for topics you would like me to write about. I’ve noted many ideas for future blog posts. Keep ’em coming. I’m always open to ideas, although I can’t promise I will use any of them.

I want to address a matter that came up with a couple of subscribers with whom I exchanged emails.

The first is from an immigration attorney who is setting up joint ventures with other lawyers and wants to know how to determine “who does what” in the arrangement, and what to do when one party turns out to do more than the other.

My answer to him was probably less than satisfying. In essence, I said that each deal is different and that all you can do is talk to your would-be JV partner and write down what each party is expected to do. If there are any issues about one side doing more than the other, you discuss it. If you can’t work it out, you move on to someone else.

There is no cookie cutter. You negotiate it. Talk it out and write it down. If things go sideways, don’t worry about it. One deal with a great outcome can more than make up for 20 deals that fizzle out.

A second subscriber, an engineer, says he struggles with marketing and wants me to point him to the “optimal marketing system”.

It seems that both subscribers want some kind of push-button system they can use in their practice. But there is no perfect system. Not even close.

We’re in the people business, and there is no one size fits all. People are flawed and emotional and mercurial. They don’t always know what they want.

Marketing legal services is messy. It’s more art than science. In fact, I told the engineer to stop thinking like an engineer and start thinking like an artist.

An engineer or a lawyer tends to look at what’s in front of him and what he can do with it. An artist, on the other hand, sees what’s not there and figures out a way to create it.

This is why I say that a marketing plan is only a place to start. It gives you direction, not a blueprint. Things change constantly and we have to be flexible enough to change with them.

I suggested to the engineer that rather than wrestle with all of the options available, he should choose something (anything) and do it. Then, he should see where he is and choose something else.

He told me about a great outcome he had in a case recently and about the nice things the client said about his work. I suggested he write down what was said and ask the client for permission to use it as a testimonial.

A place to start.

You need to know where you want to go with your practice, and then take action to move in that direction. Along the way, the variables may confound and confuse you, but as long as you know where you want to go and you keep moving in that direction, you will get to the next stop.

How to get your employer to approve your marketing plan

Back when I was selling a relatively expense marketing course, from time to time I would hear from lawyers asking for suggestions for getting their firm to pay for the course. “If nothing else works,” I said, “see if they will agree to reimburse you after you bring in a new case or client using what you learn. If not, negotiate. Maybe they’ll split the cost.”

No risk to them. How could they say no?

The other issue, then and still today, is that some firms aren’t always on board with some of their associates’ marketing activities. How do you convince them that what you want to do isn’t a waste of time or money and won’t embarrass them?

How do you get your employer or partner to approve your marketing plan?

I have a few suggestions.

First up, it’s often better to beg for forgiveness rather than ask for permission. Especially when what you’re doing is working and you’re bringing in new paying clients. Money is a salve for all wounds.

So do what you want to do (on your time and your dime) and show the firm that it’s working.

What if what you want to do will take a long time to bear fruit and you can’t hide it that long? What if it is difficult to tie what you’re doing to the results you’re getting?

In this case, instead of running at full speed, start with baby steps.

For example, I consulted with a lawyer recently about his firm’s website which is sadly in need of work. I suggested he create his own website. Start with one page, with just his bio, practice areas, contact information, and a link to the firm’s website.

Show this to your overseer and get them to okay it. It’s really nothing more than a business card and they can hardly argue that it is radical or harmful in any way.

Once you have buy in, you can (slowly?) add features to the site and see what they think.

You might add a contact form, for example, so visitors can email you directly from the site. Or a page with some details about your services. If anything isn’t approved, you can always modify it or remove it; you’ll stilll have the basic site and you can try again later.

By the way, every lawyer who works for a firm should have their own web presence. You want to brand your name online, not your firm’s. Even if you are a partner in your firm. In case you haven’t heard, partnerships do break up.

For other marketing ideas, try nibbling away at current protocol by suggesting variations on what is already approved, rather than suggesting something completely different. If you have a standard lunch presentation you do now, suggesting a different topic or different venue should be relatively easy to get approved. Suggesting advertising to a firm that has never advertised is a different story.

Another idea for convincing your firm to okay one of your ideas is to find other lawyers in your jurisdiction who are doing something similar. Use them as a case study to show your firm that what you propose isn’t unusual and, as they can see, it actually does work.

This can work especially well if the lawyer(s) you point to are direct competitors with your firm.
